This agreement is between you and Kaiser Technologies and includes our Service Terms, along with important provisions regarding dispute resolution through arbitration. By accessing or using our Services, you acknowledge and agree to these Terms.

This Privacy Policy outlines our practices regarding the Personal Information we gather when you access our website, applications, and services (collectively referred to as “Services”). Please note that this Privacy Policy does not pertain to content processed on behalf of our business customers, such as through our API, as the use of that data is governed by the agreements we have with those customers.

Terms of Service

Welcome to Kaiser Technologies. We are a research and development company dedicated to advancing the digital transformation of the world.

Molecubits is designed for verified users holding institutional email addresses, which require confirmed identities. To gain access to our Services, you must register by providing accurate and complete information. It is your responsibility to keep your account credentials confidential and not to share them with others. You are accountable for all activities that occur under your account. If you are registering on behalf of another individual or organization, you must ensure you have the authority to accept these Terms on their behalf.

By adhering to these Terms, you are granted the right to access and utilize our Services.

You are prohibited from using our Services for any illegal, harmful, or abusive purposes. Specifically, you must not:

• Engage in activities that infringe upon or violate the rights of others.
• Modify, copy, lease, sell, or distribute any part of our Services.

Some features, such as browsing tools, may yield outputs from these services (“Third-Party Outputs”). Please note that Third-Party Services and Outputs are governed by their own terms, and we accept no responsibility for them.

We welcome your feedback and suggestions. By providing feedback, you grant us the right to use it without any restrictions or compensation.

You may submit input to our Services (“Input”) and receive corresponding output (“Output”). Together, Input and Output are referred to as “Content.” You are responsible for your Content and must ensure compliance with applicable laws and these Terms. You affirm that you have all necessary rights to submit Input.

You retain ownership of your Input and hold rights to the Output. We assign to you all rights we may have in the Output generated from your Input.

Due to the nature of our Services and the capabilities of artificial intelligence, outputs may not be unique, and other users might receive similar outputs. Our assignment of rights does not extend to outputs generated for other users or any Third-Party Outputs.

If you prefer not to have your Content used for model training, you can opt out by following the instructions in our Help Center. Be aware that opting out may limit the ability of our Services to better suit your specific needs.

Artificial intelligence and machine learning are dynamic fields that are continually evolving. While we strive to improve the accuracy and reliability of our Services, the probabilistic nature of machine learning means that outputs may not always accurately represent real entities or situations.

By using our Services, you understand and agree to the following:

• Outputs may not always be accurate. They should not be relied upon as the sole source of truth or as a substitute for professional advice.
• You are responsible for evaluating the accuracy and appropriateness of outputs for your specific use case, including conducting human reviews as necessary.
• You must refrain from using outputs related to individuals for decisions that could significantly impact them, such as those involving credit, employment, or health.
• Our Services may produce incomplete, incorrect, or potentially offensive outputs that do not reflect our views. References to third-party products or services do not imply endorsement or affiliation.

You may stop using our Services at any time. We reserve the right to suspend or terminate your access to our Services or delete your account if we determine:

• You have violated these Terms or our Usage Policies.
• We need to comply with legal obligations.
• Your use poses a risk to Kaiser Technologies, other users, or any third party.

We may also terminate accounts that have been inactive for over a year, provided there is no paid subscription. If we take such action, we will give you advance notice.

If you believe your account has been suspended or terminated in error, you may submit an appeal to our Support team.

We may choose to discontinue our Services at any time. Should this occur, we will provide advance notice and issue refunds for any prepaid, unused Services.

Disclaimer

Our services are provided “as is.” Except to the extent prohibited by law, we, along with our affiliates and licensors, make no warranties—express, implied, statutory, or otherwise—regarding the services. We disclaim all warranties, including but not limited to those of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, and quiet enjoyment, as well as any warranties arising from any course of dealing or trade usage. We do not warrant that the services will be uninterrupted, accurate, error-free, or that any content will be secure, not lost, or altered.

You accept and agree that any use of outputs from our service is at your sole risk. You should not rely on the output as your sole source of truth or factual information, nor as a substitute for professional advice.

Neither we nor any of our affiliates or licensors will be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other losses, even if we have been advised of the possibility of such damages. Our aggregate liability under these terms will not exceed the greater of the amount you paid for the service that gave rise to the claim during the 12 months before the liability arose or one hundred dollars ($100). These limitations apply only to the maximum extent permitted by applicable law.

When you upload any data, text, or other works of authorship (collectively referred to as "Customer Data"), you maintain ownership of this information. You can choose to enable "Privacy Mode," which restricts Kaiser Technologies from using your Customer Data beyond generating real-time suggestions. In this mode, your data is deleted immediately after use, ensuring that it is not retained or used for any other purposes, including the training of AI models.

2. Ownership and Proprietary Rights

Rights to the Service and Materials: Kaiser Technologies retains all rights, title, and interest in the Service and its associated materials. This includes the visual interfaces, graphics, design, compilation, information, data, computer code (both source code and object code), products, software, and all other elements of the Service ("Materials"). These Materials are protected by intellectual property laws. Users are granted limited rights to access and utilize the Service; however, any unauthorized use of the Materials is strictly prohibited. There are no implied licenses, and Kaiser Technologies reserves all rights not expressly granted in the terms.

Suggestions: Users may generate outputs or functions based on their input, referred to as "Suggestions." While Kaiser Technologies assigns all rights to you concerning any Suggestions generated, it is essential to note that these outputs are created automatically through machine learning technology. As a result, Suggestions may resemble those provided to other users, and no exclusive rights are granted for outputs generated for other customers. Users must be aware of the limitations inherent in AI-generated content, including potential inaccuracies, biases, and the lack of emotional nuance. You are responsible for evaluating the usefulness and appropriateness of any Suggestions provided by the Service.

3. Customer and Usage Data

Customer Data: Any Customer Data submitted to the Service will be used solely for the purpose of generating Suggestions unless you opt-in to allow Kaiser Technologies to utilize this data for service improvements or other purposes. In "Privacy Mode," your data is used only for real-time generation of Suggestions and is promptly deleted afterward.

Usage Data: Kaiser Technologies may collect and analyze usage data that relates to your access and interaction with the Service. This Usage Data is distinct from Customer Data and will not contain any personally identifiable information. It is used solely for service delivery, performance monitoring, and technical issue resolution. Kaiser Technologies may also anonymize and aggregate this data to enhance our products and services.

At Kaiser Technologies, we are dedicated to ensuring that you have the rights and tools necessary to control your information. Your trust is our priority, and we strive to provide a transparent and secure environment for all users.

Beta services

This section outlines your use of services or features that Kaiser Technologies offers on an alpha, preview, early access, or beta basis (“Beta Services”). Beta Services are provided “as-is” for testing and evaluation purposes, and they are not covered by any indemnification obligations that Kaiser Technologies may have to you.

Kaiser Technologies does not make any guarantees regarding Beta Services, including the assurance that they will be available, uninterrupted, or free from errors. We also cannot promise that your content will be secure or that it will not be lost or damaged. To the extent permitted by law, Kaiser Technologies disclaims all warranties related to Beta Services, including implied warranties of merchantability, quality, fitness for a specific purpose, non-infringement, or any warranties arising from trade practices.

Additionally, Kaiser Technologies reserves all rights regarding the free Molecubits credits offered at the launch of the beta. These credits are intended for promotional purposes and may be subject to specific terms and conditions. We retain the right to modify, suspend, or discontinue the availability of these credits at any time, without prior notice.
